In theory, yes. Any design change to an item has the potential to reduce risks and therefore increase safety.

However, there is always potential that persons will not adhere to safety systems and such be inured or killed.

Minimum safety should be dependent on the bikes use. This differs greatly across use in the agricultural sector and private usage.

Minimum safety should be ROPS and engine cut-offs when the bike senses it is beyond certain angles (e.g. tipping).

However, the task of the bike must be considered. E.g. Spot spraying in an orchard at low speed is very different to mustering.

4) If your view is that design features should be mandated or prohibited to increase quad bike safety, could the regulation be designed to encourage innovation rather than prescribing particular products or technical solutions (for example by ensuring fitting points or attachment mechanisms to allow the development of improved CPDs or ROPSs or by prescribing performance-based outcomes rather than technical designs)?

No. It should be prescribed to give business confidence that they are compliant with regulation.

I would imagine limited cost.

However the cost to existing bikes must be considered (e.g. it costs between 500 and 1000 to retrofit a ROPS onto an existing bike).

This is a suitable approach if use is considered.

As above. The laws need to ensure a fair opportunity for existing bikes to become compliant and this should be bolstered by a grant for the ag sector.
