Overview

The Australian Competition and Consumer Commission (ACCC) is conducting a review into unsolicited selling and lead generation. This public consultation is the first step in the ACCC's review.

The consultation paper focuses on:

  • the consumer experience of unsolicited selling
  • unsolicited selling structure and practices, including the role of incentives such as commission-based remuneration
  • the role of lead generation, including the role of advertising on social media channels
  • whether there are any issues with the application of the Australian Consumer Law, including the unsolicited consumer agreements provisions, that mean that harmful conduct is not adequately addressed.

The ACCC encourages industry participants, consumer groups, the public, and experts to make a submission on the issues set out in the consultation paper. Your views will help to shape the ACCC's thinking about current market practices.

Making a submission

We have set out questions in the consultation paper for those wishing to make a submission. This is a guide only and the ACCC will consider all issues raised in submissions that are relevant to the review. We are also keen to hear from you on any other issues you consider important.

We invite interested parties to provide responses by 31 July 2025. Written submissions can be emailed directly to unsolicitedsellingreview@accc.gov.au.

How your submission will be used

The ACCC will not publish submissions. However, we may refer specifically to individual submissions in our public findings at the conclusion of the review, unless submission material is marked as confidential.

The ACCC will handle personal information collected in this consultation in accordance with the Australian Privacy Principles and our Privacy Policy. What will happen next?

Following this consultation process, the ACCC intends to publish a report on our findings, to explain how businesses use unsolicited selling and lead generation, and how this impacts consumers. Pending the findings of our review, our report may include suggestions for how any potential issues with unsolicited selling and lead generation could be better addressed.
