Overview

In the coming weeks the Australian Government will implement reforms to the Competition and Consumer Act 2010 (CCA) prohibiting parties from engaging in a concerted practice that has the purpose, effect, or likely effect of substantially lessening competition.

We have prepared interim guidelines to help businesses understand and comply with the law. The interim guidelines sets out how the ACCC proposes to interpret the new provision and describes the general approach we will take in investigating alleged contraventions.

Why your views matter

We are seeking feedback on the interim guidelines to assist us in preparing a final version. In particular, we are interested in feedback from consumers, businesses and other stakeholders about the issues and topics covered in the interim guidelines to ensure that we provide suitable guidance on the recent reforms and how we will approach potential breaches of the concerted practices provision.

How to Make a Submission

Interested parties can upload a submission on the interim guidelines. A PDF format is preferred, and please include your name, organisation and contact details when making a submission.

Submissions are due by 5pm, 1 December 2017.
